Terms of Service — Boxset.ai

These Terms of Service (“Terms”) govern your access to and use of the Boxset.ai platform (the “Service”) operated by Boxset.ai (“Boxset”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

Boxset.ai provides an AI-powered email deliverability intelligence platform that includes:

Email warmup and sender reputation building
DNS health monitoring (SPF, DKIM, DMARC, MTA-STS, BIMI)
Inbox placement testing and monitoring
Email infrastructure health scoring
Deliverability analytics and reporting
Mailbox connection management via OAuth or SMTP/IMAP credentials

3. Account Registration

To use the Service, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activity under your account

4. Mailbox Connections & Permissions

4.1 OAuth Connections

When you connect a mailbox via OAuth (Gmail, Google Workspace, Outlook, Microsoft 365), you authorize the Service to access your email account with the permissions you grant during the OAuth consent flow. These permissions are used solely to provide the Service features described above.

4.2 Credential-Based Connections

When you connect a mailbox via SMTP/IMAP credentials, you confirm that you have the authority to use those credentials and authorize the Service to send and receive emails on your behalf for warmup and deliverability purposes.

4.3 Revocation

You may disconnect any mailbox at any time through the Service dashboard. For OAuth connections, you may also revoke access directly through your email provider's security settings.

5. Acceptable Use

You agree not to use the Service to:

Send spam, phishing, or unsolicited bulk emails
Violate any applicable laws or regulations, including CAN-SPAM, GDPR, and other anti-spam legislation
Impersonate any person or entity
Distribute malware, viruses, or harmful content
Attempt to gain unauthorized access to other users' accounts or our systems
Interfere with or disrupt the Service or its infrastructure
Use the warmup feature for mailboxes you do not own or have authorization to manage
Resell or redistribute the Service without our written consent

6. Warmup Network

The email warmup feature works by sending warmup emails from your mailbox to mailboxes that Boxset.ai owns and operates. By enabling warmup, you agree that:

Your mailbox will send automatically generated warmup emails to Boxset.ai-owned mailboxes
Warmup emails are automatically generated and do not contain your personal or business content
The engagement that builds your reputation — opening, reading, and rescuing a message from spam — is performed by the Service inside the Boxset.ai-owned mailboxes that receive your warmup email, never inside yours. For a Gmail or Google Workspace account connected via OAuth, the Service holds send-only access and cannot read or modify your mailbox at all
If you connect a mailbox with an app password over IMAP/SMTP, you may optionally allow the Service to receive warmup email into that mailbox. This is off unless you enable it

7. Subscription & Payments

Some features of the Service require a paid subscription. By subscribing, you agree to:

Pay the applicable fees as described at the time of purchase
Provide valid payment information
Accept that subscriptions auto-renew unless cancelled before the renewal date

8. Intellectual Property

The Service, including its design, code, algorithms, and content, is owned by Boxset.ai and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Data Handling

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described therein.

9a. SMS / Text Messaging Terms

If you give us your mobile number and check the SMS consent box on our SMS sign-up page, you agree to receive recurring automated text messages from Boxset.ai about email deliverability and sending-reputation alerts, inbox warm-up and account updates, and replies to questions you send us. Consent is not a condition of buying or receiving any service.

Message frequency is low, typically 0-4 messages per month. Message and data rates may apply. Reply STOP or UNSUBSCRIBE to any message to cancel, or HELP for help; you can also email [email protected]. Carriers are not liable for delayed or undelivered messages. 10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee:

Specific deliverability outcomes or inbox placement rates
Uninterrupted or error-free operation of the Service
That the Service will meet all of your requirements

Email deliverability depends on many factors outside our control, including email provider policies, content quality, and sending practices.

11. Limitation of Liability

To the maximum extent permitted by law, Boxset.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. You may close your account at any time by contacting us. Upon termination:

Your access to the Service will cease immediately
Connected mailbox credentials and OAuth tokens will be deleted
Data retention will follow our Privacy Policy

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Boxset.ai operates, without regard to conflict of law provisions.
